CLEVELAND -- A federal judge says a lawsuit over a staph infection that benched former Cleveland Browns wide receiver Joe Jurevicius can move forward in a state court against the team and the Cleveland Clinic.
Jurevicius sued in June, saying the Browns misrepresented the cleanliness of their training facility and claiming doctors were negligent over a 2008 infection in his right knee.
Judge Solomon Oliver Jr. on Wednesday ruled six of Jurevicius' eight claims should be decided in a Cuyahoga County court. He dismissed two claims and said they should be handled through arbitration.
The Browns had argued that all claims should be dismissed and handled through the arbitration process provided in the NFL's collective bargaining agreement. The clinic previously said it would have no comment on pending litigation.
Jurevicius was released by the Browns in March 2009.
